Introduction

Total Terminals International, LLC (“TTI”) is committed to protecting the privacy and security of your Personal Information. This Privacy Policy (the “Policy”) describes how TTI may collect and use your Personal Information and Anonymous Information (collectively, “Information”), including through www.totalterminals.com and other websites and applications that fall under this Policy (collectively, the “Websites”).

“Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with any individual or household. Personal Information does not include publicly available information that is lawfully available to the general public. “Anonymous Information” means information that does not identify a specific individual or household.

TTI collects data about users of the Websites; about individuals who contact TTI online, by telephone or electronic means, or in person; about individuals who visit TTI’s facilities or operations; about individuals who attend events organized or hosted by TTI; about TTI’s customers or prospective customers (where these are natural persons) or their employees, agents, and representatives; and about others who express an interest in TTI or with whom TTI carries on business (collectively, these individuals about whom TTI collects data are referred to as “you” and “your” in this Policy).

This Policy describes the types of Information TTI may collect from you or that you may provide when you visit the Websites or otherwise contact TTI, and TTI’s practices for collecting, using, maintaining, protecting, and disclosing that Information.

This Policy applies to Information collected by TTI:

  • On the Websites.
  • In email, text, and other electronic messages between you and TTI, including between you and TTI’s website.
  • As a result of any transactions made with TTI.
  • Any paper submitted by you to TTI offline.

Please read this Policy carefully to understand TTI’s policies and practices regarding your Information and how TTI will treat it. If you do not agree with TTI’s policies and practices, you have the choice not to use the Websites or submit Information to TTI. 

By accessing or using the Websites and/or submitting Information to TTI, you agree with this Policy. 

When TTI makes changes to this Policy, it will be updated on TTI’s website at: www.totalterminals.com, including the effective date of the update. Please visit TTI’s website regularly to find out whether any changes have been made to this Policy, which will be noted by the version date listed in section 9 “Changes to This Privacy Policy” below.

TTI is based in the United States and the Information collected is governed by U.S. law. If you are accessing the Websites from outside of the U.S., please be aware that Information collected through the Websites may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Data protection laws in the U.S. and other jurisdictions may be different from those of your country of residence. Your use of the Websites or provision of any Information therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of Information about you in the U.S. and other jurisdictions as set out in this Policy.

1. SCOPE

This Policy describes the treatment of Information provided to or collected by the Websites or otherwise provided to TTI. TTI follows this Privacy Policy in accordance with applicable laws in the places where TTI operates.

Please know that when you provide Information to TTI via a third-party site or platform, the Information you provide may be separately collected by the third-party site or platform. Only the Information TTI directly collects is covered by this Policy, and the Information collected by the third-party site or platform is subject to the third-party site or platform’s privacy practices. Privacy choices you have made on the third-party site or platform will not apply to TTI’s use of Information TTI has collected directly. Please also note that the Websites may contain links to other sites not owned or controlled by TTI and TTI is not responsible for the privacy practices of those sites. It is your responsibility to be aware when you leave the Websites and to read the privacy policies of other sites that may collect your Information.

2. SOURCES OF PERSONAL INFORMATION

TTI collects two basic types of information: Personal Information and Anonymous Information. TTI collects certain Personal Information that you provide while contacting TTI or otherwise utilizing TTI’s services. TTI also collects Anonymous Information, which means information that does not identify a specific individual, via automated technology when you visit the Websites.

TTI collects and uses such Information only as permitted or required by, and in compliance with, law. If you choose not to share the requested Information with TTI, TTI would not be able to meet some of its purposes, as described in this Policy.

3. CATEGORIES OF PERSONAL INFORMATION

TTI collects the following categories of Personal Information for the purposes described below:

Identifiers

This includes company name, contact information, driver’s license, Transportation Worker Identification Credential, and other identification information. TTI collects this Information via the Websites, as well as from visitors, vendors, contractors, and truck drivers who visit TTI’s physical location. TTI uses this Information to communicate with you, ensure security of TTI’s physical location, to provide services, to execute contractual obligations, to meet legal obligations, for management purposes, to prosecute damage and criminal acts as well as actions that are prohibited by TTI’s internal policies and procedures, and to conduct internal investigations of suspected criminal or prohibited behavior.

If your business or organization transfers any Personal Information concerning employees or other representatives to TTI, TTI expects you to inform your employees, executives, or other representatives about this. You can give this Policy to them so that they can learn how TTI handles their Personal Information.

Customer Records Information

This includes company name, contact information, and payment information. TTI collects this Information via the Websites and through other means from clients and their representatives, individuals who show an interest in TTI or its products and services, individuals who are connected in another way with a business or organization with which TTI has, wants to have, or has had a business relationship, security providers, and potential clients. TTI uses this information to enter into a business relationship and agreement with you, perform agreements and carry out instructions, protect your security and integrity as well as the security and integrity of TTI and others, help develop and improve products and services, engage in account management, enter into agreements with suppliers and other parties with whom TTI works, comply with legal obligations, carry out business processes, and for the purpose of management reports and internal management.

Biometric Information

TTI does not collect biometric information. TTI has CCTV cameras on and around our physical sites. These cameras may occasionally make recordings of you as you pass the areas that are covered by the CCTV cameras. The camera recordings are typically removed after eight weeks, and no facial recognition or other biometric information is collected from these images. However, the recordings may be kept for a longer period, for example, in case of an accident investigation or other valid reasons.

Internet or Other Electronic Network Activity Information

This includes fully anonymized Information related to the activity on the Websites. TTI uses this Information solely to ensure the security and performance of the Websites.

Geolocation Information

TTI collects data related to over-the-road trucker locations. RFID tags are read as trucks enter and process through TTI’s facility. This data is used to locate the shipping container associated with the trucker for that visit in order to facilitate work instructions. TTI does not manage or track location data outside the perimeter of its facility and does not have access to location tracking data that companies use to manage their fleet.

4. SHARING YOUR PERSONAL INFORMATION WITH OTHERS

TTI does not sell, share, or otherwise disclose, for monetary consideration, your Personal Information to other parties. TTI may share Anonymized Information to maximize site security and improve the performance of the Websites.

5. DATA SECURITY

The security, integrity, and confidentiality of your Personal Information are extremely important. TTI has implemented technological and organizational measures to safeguard your Personal Information. Your Information will be stored as required for the purposes for which it was initially collected, which may vary depending on the type of Information collected and its purposes.

6. RETENTION OF PERSONAL INFORMATION

TTI will retain your Personal Information only for as long as needed to carry out the purposes for which it was collected, or as required by law.

7. NOTICE REGARDING MINORS

TTI does not knowingly collect, maintain, or use Personal Information from children under eighteen years of age, and no part of the Websites are directed at children. By using the Websites, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority in your state, province, or country of residence and you have given TTI your consent to allow any of your minor dependents to use the Websites.

If you learn that a child has provided TTI with Personal Information in violation of this Policy, or you are under 18 and would like Personal Information you provided to TTI to be removed, please alert TTI by email at TTICompliance@totalterminals.com.

8. STATE PRIVACY RIGHTS

Residents of certain U.S. states, including California have unique rights available to them under state data privacy laws. Depending on your residency, you may have different rights. This section describes those rights and explains how to exercise those rights.

Right to Request Disclosure About the Data Collected About You

You may have the right to request that TTI disclose certain information to you about our collection and use of your Personal Information. Once TTI has received and verified your request, TTI will disclose to you:

  • The specific pieces of personal information we collected about you.
  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.

However, TTI will not at any time, in response to a request, disclose a financial account number, an account password, or security questions and answers. TTI is not required to retain any Information collected for a single, one-time transaction if the Information is not regularly retained by TTI, nor re-identify any Anonymous or de-identified Information, in order to disclose that Information to you.

Correction and Deletion Request Rights

You may have the right to request that TTI correct or delete any of your Personal Information that was collected from you and retained, subject to certain exceptions. Once TTI has received and verified your request, TTI will correct or delete your applicable Personal Information from its records, unless an exception applies.

TTI may deny your deletion request if retaining the Personal Information is necessary for TTI or its service provider(s) to:

  • Complete the transaction for which the Personal Information was collected, provide a good or service that you requested, take actions reasonably anticipated within the context of the ongoing business relationship with you, or otherwise perform contractual obligations with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the Information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with TTI.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that Information that are compatible with the context in which you provided it.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information for data and to delete data. You may only make a verifiable consumer request for data access twice within a twelve-month period.

The verifiable consumer request must:

  • Provide sufficient information that allows TTI to reasonably verify you are the person about whom TTI collected personal information or your authorized representative.
  • Describe your request with sufficient detail that allows TTI to properly understand, evaluate, and respond to it.

TTI cannot respond to your request or provide you with Personal Information if it cannot verify your identity, or your authority to make the request, and confirm the Personal Information relates to you. TTI will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Any request to delete Personal Information which is submitted through an online request will first require you to submit the request, and second, separately confirm that you will want the information deleted.

For all requests made pursuant to the California Consumer Privacy Act (“CCPA”), TTI will endeavor to respond to a verifiable consumer request within forty-five days of receipt. If TTI requires more time, you will be informed the reason and extension period. Any disclosures that provided by TTI will only cover the twelve-month period preceding the verifiable consumer request’s receipt. For information portability requests, TTI will also explain the reasons it cannot or will not comply with a request, if applicable.

Non-Discrimination

TTI will not discriminate against you for exercising any of your data subject rights after you have exercised those rights. Unless permitted by the applicable state law, in response to exercising your rights, TTI will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

9. CHANGES TO THIS PRIVACY POLICY

Please note that TTI may update or change this Policy from time to time at its sole discretion. When TTI makes changes to this Policy, the update will be posted on www.totalterminals.com and will include the date of the update. Your continued use of the Websites following the posting of changes constitutes your acceptance of such changes. The most current version of this Policy will govern the use of your Information.
